Settlement Details
The class action lawsuit alleges that Calmark Group failed to obtain employee consent before collecting and storing biometric data, such as fingerprints and hand scans, through its timekeeping systems. This practice allegedly violated the Illinois Biometric Information Privacy Act (BIPA).
Although Calmark denies any wrongdoing, it agreed to the settlement to resolve these claims. Under the terms of the settlement, eligible class members can receive an equal share of the net settlement fund.
How to File a Claim
Eligible individuals must submit a valid claim form by May 18, 2024, to receive their payment. Claims must be filed under penalty of perjury, and fraudulent claims may harm other eligible class members.
